Environment Protection Authority

Four Penalty Notices for Waste Tyre facilities

Media release: 6 June 2016

The NSW Environment Protection Authority (EPA) has issued four penalty notices of $1500 each to Apex Rubber Recycling Pty Ltd in Riverwood, Renew Rubber Pty Ltd in Greenacre, 7 Star Tyres Pty Ltd in Sefton and BSV Tyre Recycling Australia Pty Ltd in Revesby on 1 June 2016.

Steve Beaman, EPA Executive Director Waste and Resource Recovery, said the fines are for failing to ensure a weighbridge was installed at each facility as expected under the revised Protection of the Environment Operations (Waste) Regulation 2014.

“Since 1 November 2014, new laws require all licensed waste facilities subject to the waste levy to install a weighbridge. All new levy liable waste facilities, including licensed waste tyre facilities, were required to install the weighbridge by 1 February 2016.

“The new reforms are aimed at combatting illegal dumping, reducing the illegal storage of waste at facilities and reducing the waste levy fraud. This is because we want all operators to operate safely and within licencing limits to protect the local community and make sure operators are properly recording how much waste is on their premises.

Throughout 2015, the EPA contacted the waste facilities to remind them of the requirements to install and use a weighbridge by February 2016.

“We also ran an educational forum specifically for the waste tyre industry to outline the new requirements, including the requirements to install and use a weighbridge. This was attended by representatives from all the relevant waste tyre recyclers in NSW.

Penalty notices are just one of a number of tools the EPA can use to achieve environmental compliance, including formal warnings, licence conditions, notices and directions, mandatory audits, enforceable undertakings, legally binding pollution reduction programs and prosecutions.
