NSW local government air quality toolkit module 2: legislative and policy framework
This module outlines the legislative and policy framework for air quality management.
The Protection of the Environment Operations Act 1997 (POEO Act) regulates pollution, including air pollution from commercial, industrial, and domestic activities. Local councils are the appropriate regulatory authorities for what are commonly known as ‘non-scheduled activities’ under the POEO Act.
This module overviews the legal framework, including national standards and state programs to manage and control air pollution. It includes information about businesses and premises regulated by local councils, as well as motor vehicles and emissions.
For NSW authorised officers and enforcement under the POEO Act, this module refers to the Powers and notices guideline. The guideline details how to use powers under that Act to manage air quality issues.
It is recommended Module 2 is read in conjunction with the Local government air quality toolkit land-use planning guidance note (PDF 5.6MB).
